GAD’s directive to Adm Secys on SRO-43

JAMMU, May 22: General Administration Department has withdrawn office memorandum dated March 16, 2012 regarding compassionate appointment under SRO-43.
Through the office memorandum (OM) bearing No. GDC/469/CM/2011 dated March 16, 2012, it was intimated that in death in harness cases, if any member of the family is already in Government service, the compassionate appointment of another member is not justified as the dependents get family pension also.
The next of kins of many such families approached the Court following which directions were issued for according consideration in such cases. Thereafter, the directions of the court were examined in the Department of Law, Justice and Parliamentary Affairs, which suggested implementation of the judgment dated February 22, 2013 with the observations that the verdict of the court was based on law and well interpretations of SRO-43 of 1994.
After examining the matter, the GAD decided to withdrawn the OM No.GDC/469/CM/2011 dated March 16, 2012 for extension of benefits to the NOKs of such families as admissible under rules of SRO-43 of 1994.
Now, while withdrawing the OM abinitio, the GAD has directed all the Administrative Secretaries to settle all such cases including those rejected earlier on this ground strictly under relevant provisions of SRO-43 amended from time to time.
