Functioning of Backward Classes Commission

Sir,
The basic institute of the State OBCs is the “State Commission for Backward Classes” which has been rendered useless for the State OBCs.
The Government has changed the basic Apex Court’s definition of Socially and Educationally Backward Classes by including RBA/ALC provision in it act and hence converted the  “State Commission for Backward Classes” into “Area Commission”.
They do not talk about the OBC castes, they talk much about the areas to be included as per the proceedings in the Legislative Assembly and also directions given by  Speaker for appointing Commission members at the earliest.
All India Backward Classes has many times suggested for Horizontal Reservation to RBA/ALC vide Para 95 of the Apex Court’s Judgment of 1992  on Mandal which does not disturb the existing reservation of any category including RBA/ALC. But Govt is adamant and acting more dictatorial as compared to the “British Rulers”.
National Commission for Backward  Classes and State Commission for backward classes in all the States have its all members including the chairperson from among the OBC castes, but it is only in the J&K State where they appoint chairperson and some members from other castes. Appointments of such chairperson and members only means to stop the functioning of the State Commission for backward classes and that too with incentives to the appointed persons.
OBC Advisory Board’s Chairman and its Vice-Chairman  must take up the issue of appointments of chairperson and members in its meeting which is due in near future from OBC castes which is logical and legal. Delay in appointments shall be considered as a neglect of the State OBCs which is no way goes in favour of the Govt.
