JAMMU, July 9: Crime Branch has registered case against a fraudster and a doctor for their involvement in the offences of cheating, fraud, forgery and criminal conspiracy.
According to the Crime Branch spokesman, an application was filed by Sanjeev Sharma, son of Kewal Krishan of Talab Tillo (accused in case FIR No 3/ 2004 titled CBI Vs Sanjeev Sharma and others) before the Principal District and Sessions Judge, Jammu seeking exemption from personal appearance on medical grounds for the hearing fixed on June 6, 2012.
The application was resisted by the prosecution on the plea that the veracity of the medical record produced in the court in support of the application was required to be verified. On this the court directed the prosecution to depute some officers to ascertain the truthfulness of the medical record.
Accordingly an officer of the rank of Inspector was deputed and he reported that the accused was never hospitalized and medical certificate produced by the accused was false and fabricated. In this backdrop, the prosecution (CBI) filed an application seeking enquiry against the accused person.
The application was treated as complaint by the Court of Sessions Judge, Jammu and the same was endorsed to CJM Jammu for action under law through Crime Branch, Jammu.
From the perusal of the complaint, it was found that accused Sanjeev Sharma in connivance with Dr Mohit Gupta had procured a false and fabricated medical certificate and produced the same with an application before the court of Principal District & Sessions Judge, Jammu seeking exemption from personal appearance on medical grounds in order to scuttle the process of law and to avoid framing of charges.
Dr Mohit Gupta in sheer abuse of his official position had issued the false and fabricated medical certificate to Sanjeev Sharma in order to save him from the due process of law obviously for certain extraneous considerations.
