Earned leave benefits

Sir,
The teaching community in the J&K State is deprived of the earned leave benefits at the time of retirement and as a result of this, injustice is being done. The teachers are deprived of the great financial benefit on the pretext of that Education Department is a vacation department so the earned leave is not entitled to them.
The vacations are not granted  on the request of the teachers but due to non-availability of infrastructure, heating and cooling arrangements in the schools and keeping in view the hot summer days which are very risky for the students. The vacations are granted for the relief of students.
To address this grievance, the matter was brought to the notice of the higher authorities of the J&K Education Department and others many times but unfortunately no concrete action has been taken so far in this regard despite repeated requests time and again. The entire teaching community of the State  under the J&K Teachers Forum warned for examination boycott of BOSE examination to press the Government to concede their demands of earned leave benefits at the time of retirement and in the month of Oct. 1998 as a consequence of  it the then Chief Minister assured in a meeting with representatives of the Forum and MTWA  that the benefit of leave encashment will be given to the teaching community and it was agreed upon that formal orders for the same would be issued within a period of  three months but to utter surprise that over 14 years have passed since then but no orders have been issued till date.
The MTWA  is  of the view that  winter vacation for the winter zone and summer vacation for the summer zone is a type of fixed leave for the teacher as the teachers are ready to render their services in vacations as well. Their services during vacations can be utilized by way of training programmes and conducting of refresher and computer courses during vacations. So that the earned leave benefit is justified.
It is requested to the concerned authorities to issue formal orders.
