Driver awarded imprisonment for causing fatal accident

MAHORE, Feb 3: Sending a strong message of zero tolerance against drivers involved in rash driving besides giving justice to the accident victims and their families, Judicial Magistrate First Class, Mahore, today awarded imprisonment and fine to the accused driver, whose negligent driving had caused death of four persons and injuries to five others.
Convict Basharat Hussain, son of Ab Majid of village Gool in District Ramban, has been sentenced to imprisonment of one year and imposed a fine of Rs 3000/- for commission of offence under section 304-A of RPC, imprisonment of one month and a fine of Rs 500/- for commission of offence under section 338 of RPC and imprisonment of three months and a fine of Rs 500/- for the commission of offence under section 279 of RPC.
In default of the payment of fine, accused shall undergo more simple imprisonment for 15 days. All these imprisonment run continuously one after another.
The said accident had taken place at Sheela Shajroo on December 2, 2010 when a TATA Sumo (JK19-0369), while coming from Mahore to Gool and rashly driven by Basharat Hussain had slipped into gorge resulting into death of Abdul Latief, Shamim Begum and Abdul Hamid on the spot while six others including driver got injured. Later on, one of the injured namely Sajad Hussain also died in the hospital. Accordingly, FIR number 146/2010, U/S 279/337/304-A/RPC was registered at Police Station Mahore and subsequently challan was produced in the court of law.
