JAMMU, June 8: Dogra Law College organized an extension lecture on Consumer Protection Act 2019, focusing on its comparative analysis with the preceding Consumer Protection Act, 1986.
The Consumer Protection Act 1986 and even the new legislation of 2019 was enacted to provide for protection of the interests of consumers and to establish authorities for timely and effective administration and settlement of consumers’ disputes and for matters connected therewith or incidental thereto.
Advocate Aseem Sawhney, J&K High Court, was the resource person, who enlightened the students about the consumer protection law and its allied matters. He stressed that law is never static and is ever evolving. While decoding the ambit and scope of Consumer Protection Act, Advocate Sawhney explained the applicability of Consumer Protection Act, 2019 and its scope in Jammu and Kashmir. To make the session more interactive, Advocate Aseem Sawhney shared his personal experiences related to consumer matters.
He stressed that consumer law is a revolutionary piece of practice and how the setting up of consumer commissions have opened up avenues for lawyers. He divulged upon the intricacies of Consumer Protection Act like maintainability of the complaint, tortuous liability, enrichment, class action suits etc. He explained the setting up of Central Consumer Protection Authority under the new legislation and how the commissions under Consumer Protection Act, 2019 have been given the powers of a Judicial Magistrate.
He enlightened the students about the territorial and pecuniary jurisdiction of the Act. While stressing upon the comparative analysis, he stated that the earlier Act was a toothless weapon and the same has been overcome by imposing civil as well as criminal liabilities under the new Act.
Earlier, the event started with the lighting of the lamp by all the dignitarie. Prominent among those present were Samar Dev Singh Charak (secretary, Dogra Educational Trust), Dr Darshana Sharma (Director DGC and Campus Development) and faculty members of DLC.
