DCs fail to comply Govt order on repatriation of Patwaris

Revenue official manages to stay despite transfer orders

Srinagar, Jan 23: Several districts have failed to comply with the Government orders to repatriate Revenue staff working in their districts in violation of Decentraliz-ation Act 2010 while some such officials are working at the same places for the last many years.
The Revenue Department issued an order (No. Rev/NG/45/2019 dated 07-07-2020) last year directing the Divisional Commissioners Kashmir and Jammu to repatriate the Revenue employees to parents districts or cadres.
“…as per the provision contained in Decentralization Act 2010, there is complete ban regarding transfer of Government employee from one district to another district/cadre. However, it has been found that some Government employees of Revenue subordinate services have managed their transfer in complete violation of rules issued by Govt from time to time and have to be repatriated to their parent district/cadre”, read the order.
The Divisional Commissi-oners were asked to furnish the list of such Revenue employees who are working outside parent district/cadre in a week’s time so that they can be repatriated.
Deputy Commissioner Srinagar, Dr Shahid Iqbal Choudhary, last week ordered (No. DCS/Estt/20/2779-90 dated 09-01-2021) repatriation of 14 Patwaris who were working in Srinagar in violation of Government order. However, several other District Magistrates have failed to comply the government order and Revenue officials belonging to other districts continue to work in other districts in violation of Government orders and rules.
Some of these Revenue officials have even managed to work at particular places of postings for last several years. A typical case is of the Revenue official, Tanvir Iqbal Khawaja, who is working in Kanispora area of Baramulla town is of district Kupwara cadre and is working at the present place of posting for last 6 years.
Deputy Commissioner Baramulla ordered (No. DCB/SQ/Estt/7547-60 dated 18/01/2018) transfer of 12 Patwaris in the district in 2018 including Khawaja who was posted at Kanispora and was shifted to Khanpora Baramulla.
However, Khawaja later managed to get the order modified in just couple of days and Deputy Commissioner Baramulla issued another order (No. DCB/SQ/Estt/7604-07 dated 24/01/2018) under which he was asked to continue at Kanispora
And two years later, in September last year, Deputy Commissioner Baramulla ordered (No. DCB/SQ/Estt/1638-60 dated 02/09/2020) transfer of 19 Patwari including Khawaja. This time he was transferred from Kanispora to Sangrama in Baramulla. However, he continues to be at same place despite passage of four and a half month in violations of DC’s order and Decentralization Act.
Later Deputy Commissioner Baramulla issued another order (No. DCB/SQ/Estt/28180-40 dated 06/10/2020) in October last year in which Tabasum Amin Khan was sent to Sangrama Patwar Halqa which was without Patwari as Khawaja failed to comply Government order.
