JAMMU, Dec 26: In the Public Interest Litigation highlighting organized land grabbing by certain police officers, politicians and bureaucrats in connivance with land mafia, Division Bench of State High Court comprising Chief Justice M M Kumar and Justice Hasnain Massodi today expressed displeasure over the non-compliance of its earlier order.
After hearing Advocate S S Ahmed appearing for the PIL whereas Senior AAG Gagan Basotra for the State, the DB took serious notice of non compliance of the orders and said, “the order dated December 18, 2012 has not been complied with and this requires an explanation as to why the recommendation dated April 24, 2006 made by the Commissioner of Vigilance Organization in the alleged encroachment of 92 kanals of State land by the Member Parliament has been kept under the wrap”.
Upon this, Senior AAG Gagan Basotra sought some time to do the needful. Considering the request of the Senior AAG, the DB granted time till January 1, 2013 with the direction that record should be produced on the next date of hearing.
In the application, it has been submitted that despite the expiry of more than six years from the date of submission of report by the Vigilance Commissioner confirming the encroachment the State land has not been vacated from the MP. “The revenue officers of district Kathua appear to be under pressure of the occupant as in response to RTI plea dated May 14, 2012, the Tehsildar Hiranagar expressed complete ignorance about the encroachment in question and also took a U-turn to the findings of the SVO”, the applicant said.
