DB’s directive in Mobile Magistrate case

JAMMU, Feb 7: In a Public Interest Litigation (PIL) filed by two young Advocates namely Rajnish Raina and Prem Sadotra (presently Joint Secretary BAJ) challenging registration of FIR against judicial officer without following the guidelines laid down by the Supreme Court, Special Division Bench of High Court comprising Justice Mohammad Yaqoob Mir and Justice Bansi Lal Bhat today allowed two weeks time to senior AAG Gagan Basotra for filing fresh affidavit and explaining the position.
After hearing Advocate Rohit Kapoor for the PIL whereas Senior AAG Gagan Basotra for the State, the Special DB, in the open court, observed, “as already noted affidavits filed by SHO Pulwama and IGP Kashmir are aimed at justifying the wrong”, adding “two weeks time is granted to the senior AAG for filing fresh affidavits”.
