JAMMU, May 8: In a petition filed by DIG Armed Jammu Kasturi Lal Bhagat challenging the order of Central Administrative Tribunal dated August 10, 2007, High Court today directed the State to give benefit of induction in IPS to the petitioner with effect from 1998.
The Central Administrative Tribunal vide its order dated August 10, 2007 had rejected the application filed by the petitioner seeking relief of constitution of review DPC for his selection and induction in IPS with effect from 1998 and consequently allotting 1994 as the order of allotment.
The judgment in the petition challenging the CAT order was reserved by Division Bench comprising Chief Justice MM Kumar and Justice Dhiraj Singh Thakur after hearing Senior Advocate DC Raina with Advocate Anil Verma for the petitioner whereas Senior AAG Gagan Basotra for the State and Advocate Advocate JA Hamal for the respondent.
While pronouncing the judgment, Justice Dhiraj Singh Thakur today directed the respondents to constitute a DPC, which shall review the case of petitioner based upon his upgraded APRs for the years 1997-98, 1998-99, 1999-2000 and make recommendations accordingly.
The High Court further directed that the process shall be concluded within three months from the date of this order. “In case, upon such a review, the committee finds that he makes up the merit, then he be given benefit of induction in IPS with effect from 1998 along with similarly situated officers, who were similarly inducted into IPS vide Notification dated March 9, 2000”, the High Court said while setting aside the order passed by the Central Administrative Tribunal.
