JAMMU, Jan 1: In a Public Interest Litigation (PIL) filed by Citizens Forum leveling allegations that fly-over project from Shakuntla Chowk-Balwinder Chowk-Ambhpalla connecting Jail road and New Plot Janipura road conceived in the year 2008 has been abandoned for some extraneous reasons, Division Bench of State High Court comprising Chief Justice MM Kumar and Justice Dhiraj Singh Thakur today directed Managing Director of J&K Economic Reconstruction Agency to appear along with record.
After hearing Senior Advocate SS Lehar with Advocate Aditya Sharma appearing for the PIL whereas AAG Seema Shekhar appearing for the State, DB observed, “according to the objections filed by the J&K ERA, it has not been stated that the project has been abandoned. The impression created is that it has either been deferred or it is required to be reviewed as per the Mobility Plan submitted by RITES”.
“There is no clear stand with regard to the loan agreement signed in the year 2008 with the Asian Development Bank and the State. Likewise, from the objections filed on behalf of the PWD (R&B) an impression has been created that the fly-over project from Shakuntla Chowk to Amphalla and towards Janipur has been abandoned and fresh recommendations for construction of monorail made by RITES are under consideration”, the DB further observed.
After going through the objections, Division Bench said, “in order to know whether the fly over project of 2008 still subsists or it has been abandoned, a perusal of the record would be necessary”. Accordingly, DB directed Managing Director, J&K ERA to appear along with the record on next date of hearing.
