DB nod to PSC on appointment of Principals

JAMMU, Dec 26: Division Bench of State High Court comprising Chief Justice N Paul Vasanthakumar and Justice Tashi Rabstan today directed the Public Service Commission (PSC) to proceed with the process of appointment of Principals in Government Degree Colleges.
The direction has been passed in a LPA filed against the interim order dated October 20, 2016 passed by the Single Judge staying the process of filling up the posts of Principals.
After hearing both the sides, the DB observed, “it is relevant to note at this juncture that the Higher Education Department initiated the process of filling up the vacancies of College Principals through Public Service Commission and the Nodal Principals, AS College Srinagar and GGM Science College Jammu were requested to furnish the APRs complete in all respects for last three years of 195 In-charge Principals/ Associate Professors by communication dated November 13, 2013”.
“Thus it is evident that process of selection of Principals was commenced by the Government from that date and Rules, which were in vogue at that time alone can be applied in terms of the judgment of Supreme Court”, the DB further said, adding “the
Public Service Commission shall proceed with the selection of Principals by promotion to such of those vacancies, which arose prior to April 21, 2014 after getting vacancy position from Higher Education Department as per the procedure in-vogue prior to April 21, 2014”.
However, the vacancies which arose after April 21, 2014 are to be filled up by following the procedure contemplated under SRO 124 dated 21.04.2014, the DB clarified.
“The writ petitioners can also participate for selection/promotion subject to their right in the writ petitions seeking regularization, which can be considered at the time of final hearing of the case”, the DB said while vacating the interim order granted by the writ court.
