DB issues notice to CS, others

JAMMU, Apr 30: In a Public Interest Litigation (PIL) filed by Mian Haji Saira seeking direction to the respondents to ensure compliance of “Right to Education” in letter and spirit and also directions to the private educational institutions against discriminating with “trans-genders” for the purpose of admitting them in education institutions, Division Bench of State High Court comprising Justice Mohd Yaqoob Mir and Justice DS Thakur issued notice to the Chief Secretary of the State, Commissioner Secretaries of School Education and General Administration Departments, Director School Education, Chief Education Officer Jammu and private educational institutions.
In the PIL, it has been submitted that the petitioner approached private schools for admission of two trans-genders namely Komal and Shammi but denied admission on the basis of their being “trans-genders”. “Due to this the educational career of trans-genders has been put to jeopardy because of discriminatory attitude of the management of private institutions”, the counsel for the petitioner said.
After hearing Advocate D S Chouhan appearing for the PIL, the DB issued notice to Chief Secretary and others. At this stage Advocate Chouhan submitted that he will get the notice personally served upon the respondents. The Division Bench also directed Registry that in view of the urgency involved the PIL should be listed next week.
