JAMMU, Feb 27: In a Public Interest Litigation (PIL) seeking withdrawal of security cover provided to 608 non-categorized persons of Jammu province purely on extraneous considerations, Division Bench of State High Court comprising Chief Justice M M Kumar and Justice J P Singh today issued notice to Chief Secretary, Director General of Police and others.
After hearing Advocates HC Jalmeria and Sheikh Najeeb Ashraf appearing for the petitioner Ghulam Ali, Division Bench observed, “the counsels for the petitioners have brought the intention of court to a very important issue—providing of security to the unspecified category of people”, adding “before approaching the court specific information was sought by the petitioner from the respondents as to who are the persons under the uncategorized category in the Jammu province who have been provided security cover”.
“The PIO for Inspector General of Police Jammu Range has merely stated that there are 608 persons by giving the data in respect of 10 districts. The Counsels for the petitioner further submitted that parameter for furnishing security, in fact, has been laid down and on the basis of threat perception security is required to be provided whereas the list furnished by the IGP Jammu would show that large number of uncategorized persons have been given security by the State at the expenses of the citizens”, the DB said.
With these observations, Division Bench issued notice to Chief Secretary, Principal Secretary Home, Commissioner/ Secretary General Administration Department, Director General of Police, Director State Motor Garages and Commissioner of Vigilance etc which were accepted by Senior AAG Gagan Basotra. The notice issued to Director Estates was accepted by AAG Seema Shekhar.
The DB directed the Registry to list the PIL on March 7, 2013.
