DB grants bail to 2 facing death penalty

JAMMU, July 7: In the much publicized murder case of contractor Yash Paul Singh, Division Bench of State High Court comprising Justice Alok Aradhe and Justice Sanjeev Kumar has granted bail to two accused.
The contractor was brutally murdered in broad-day light by seven accused on April 7, 1995 and Trial Court awarded, six accused Jagvinder Singh, son of Jagjit Singh of Ward No 11 Kathua, Varinder Kumar, son of Bishan Dass of Nagri, Jasbir Singh, son of Raj Singh of Kathua, Ram Nath Raina, son of Girdhari Lal of Kathua, Gurdeep Singh, son of Harbhajan Singh of Swan Chak and Ajay Kumar, son of Bal Krishan of Kathua with death penalty.
However, Jagvinder Singh and Varinder Kumar moved an application seeking suspension of sentence and grant of bail.
After hearing Advocate RK Kotwal for the accused persons whereas AAG LK Moza for the State, the DB while referring to the judgment delivered by Supreme Court in case titled Bhim Singh Versus Union of India and others as well as judgments delivered by the State High Court in a Criminal Appeal titled Ravinder Singh and Others Versus State, observed, “normally when the accused/appellant has remained in jail for a period of more than 10 years and there is no likelihood of appeal being heard in near future, the appellant should be released on bail”.
“In view of this proposition of law laid down by the Supreme Court as well as the Division Bench of this court and taking into account the fact that appellants are in jail for the past about 11 years and there is no likelihood of appeal being heard in near future, as the appeals of year 2004 are being heard, we deem it appropriate to enlarge appellants on bail subject to certain conditions”, the DB said.
The court directed the appellants to furnish   personal   bond   in   the   amount   of Rs 50,000 each with two sureties of like amount each to the satisfaction of Registrar Judicial. “They shall not leave the State without permission of this court and they shall appear before this court on each and every date of hearing”, the DB added.
