JAMMU, Apr 25: A Division Bench of Jammu & Kashmir and Ladakh High Court comprising Justice Sanjeev Kumar and Justice Rajesh Sekhri today expressed displeasure about the standard of investigation carried out in NDPSA case.
“The cases related to the drug peddling have shown an alarming surge from past many years and this part of the country has emerged as a new breeding ground entrapped in the tentacles of the menace which has taken the shape of an industry with criminal minded people hell bent to destroy the blooming youngsters and incapacitate their minds and souls”, the DB observed.
“It may seem to be an ordinary crime but there is no denying the fact that money generated from this trade, finds its use in financing the subversive activities and the acts inimical to the security and stability of the nation”, the DB added.
Upholding the judgment of trial court in acquittal and dismissing the appeal filed by UT, the DB observed, “we do not find any merit in the present appeal, which is liable to be dismissed and consequently, impugned judgment, being well reasoned, is liable to be upheld”.
The appeal was filed against judgment dated 13.09.2022 passed by the court of Principal Sessions Judge, Jammu in challan titled State Versus Pardeep Singh and Another and FIR No. 33 of 2007 of Police Station Miran Sahib for offences under Section 8/15/29 of Narcotic Drugs and Psychotropic Substance Act, 1985 vide which respondent was acquitted of the charges.
