JAMMU, Dec 28: Division Bench of State High Court comprising Chief Justice N Paul Vasanthakumar and Justice Tashi Rabstan today dismissed the appeal filed by General Administration Department against Farooq Khan, the then IG and presently BJP leader in the much publicized Pathribal encounter.
After hearing Advocate Ashtham Bhat appearing for the GAD, Division Bench observed, “during the pendency of the CBI investigation, the Inquiry Commission’s findings were set aside by the Writ Court by order dated 18.02.2005”, adding “after passing of the order, the CBI completed the investigation in respect of complicity of the respondent and by letter dated 29.07.2005, Deputy Inspector General of Police stated that CBI investigation is over and the case is under legal scrutiny”.
“It is further stated in the letter that the investigation conducted by CBI has not brought out any involvement of the respondent, the then SSP Anantnag. Investigation conducted by CBI has not brought out any involvement of Farooq Ahmed Khan, the then SSP Anantnag”, the DB said, adding “in the light of the clean chit given by the CBI with regard to the involvement of the Farooq Khan, the order of Single Judge cannot be interfered”.
With these observations, Division Bench dismissed the appeal.
