JAMMU, July 23: In a Public Interest Litigation (PIL) filed by Rufi Khan and others seeking effective prosecution of criminal trials particularly involving capital sentence and life imprisonment and manning of Legal Remembrance posts by Judges, Division Bench of State High Court comprising Justice Dhiraj Singh Thakur and Justice Janak Raj Kotwal today directed the State to file appropriate reply within next four weeks.
After hearing Advocate Rohit Kapoor appearing for the PIL, DB observed, “pursuant to order dated June 11, 2014, the respondents were yet again directed by virtue of order dated May 26, 2015 to file comprehensive report indicating guidelines, if any, for appointment of Public Prosecutors and Additional Public Prosecutors and also status of the recommendations made by the Committee headed by the Advocate General”.
“The counsel for the respondents submits that a Committee is being constituted which will prepare a report indicating the guidelines for appointment of Public Prosecutors and Additional Prosecutors. He assures that the needful will be done within a period of four weeks”, the DB further observed.
“We may observe that despite order passed as back as on 11.06.2014, the State is still found struggling at the stage of constitution of appropriate Committee for making concrete recommendations after collecting requisite data and inputs from various concerned quarters”, the DB noted with serious concern, adding “we hope that the assurance given by the counsel for the respondents is not belied and an appropriate reply is filed by the next of hearing”.
