JAMMU, Apr 22: In a petition filed by Bar Association regarding construction of chambers and multi-storey parking in the Janipur Court Complex, Division Bench of State High Court comprising Chief Justice M M Kumar and Justice D S Thakur today directed Secretary Law Department to take decision within three weeks or remain present in person before the Court on the next date of hearing to explain the reasons behind the delay.
When the petition came up for hearing, Senior Advocate D C Raina appearing for the JKPCC pointed out that there was deficiency of funds and to achieve the target, a letter was addressed to Secretary Law bringing to his notice that an amount of Rs 1352.93 lakh was required to be released in favour of JKPCC at the earliest, so as to enable it to purchase additional construction material and gear-up the pace of work within stipulated period. However, there was no response from the Law Secretary.
Advocate General MI Qadri appearing for the State submitted that the matter was under active consideration of Law Department and assured the Division Bench that final decision was expected within three weeks. Upon this, Division Bench directed Law Secretary that if the decision is not taken within next three weeks he shall remain present in the Court on next date of hearing to apprise court as to why delay is being caused.
Regarding multi-tier parking, Senior Advocate M K Bhardwaj, President Bar Association submitted that the matter will be discussed in the executive body of the Bar and then objections will be filed.
Regarding alternate road for High Court Judges, Division Bench granted four weeks time as sought by ASGI KK Pangotra appearing for the Union of India because the matter was under active consideration of the Government of India, Ministry of Defence.
