JAMMU, May 15: In a Public Interest Litigation (PIL) filed by Citizen Forum through its President RK Chadha regarding abandoning of Shakuntla Chowk-Balwinder Chowk-Ambhpalla flyover for some extraneous reasons, Division Bench of State High Court comprising Justice Hasnain Masoodi and Justice Janak Raj Kotwal today directed the Chief Secretary to file affidavit within two weeks.
After hearing Advocate Aditya Sharma for the PIL whereas Senior AAG with Deputy AG for the State, DB observed, “in terms of order dated February 19, 2015, Chief Secretary was required to file an affidavit detailing the decisions of the State Government with regard to construction of fly-over and widening of the road”.
“The affidavit is yet to be filed”, the DB noticed and directed Chief Secretary to file affidavit within two weeks.
“The status report filed by ERA would reveal that some steps were taken towards execution of the project—fly-over from Shakuntla Chowk to Amphalla Chowk having two limbs. Initial steps like publication or acquisition notice dated 07.10.2009 have been taken, consultants engaged to prepare the Detailed Project Report (DPR). However, nothing has been done thereafter”, the DB observed.
“The report filed by ERA is not leading anywhere unless Chief Secretary takes a clear and definite stand in the matter”, the DB said.
