JAMMU, Sept 14: Crime Branch has registered a case against four persons including Custodian Evacuee Property Jammu for committing fraud by preparing fake rent deed.
According to the Crime Branch spokesman, one Wali Mohd of Kot-Bhalwal lodged a written complaint alleging that land falling under Khasra No. 2056 situated at village Bhalwal was a disputed land and a case titled Fatima Bibi V/s Custodian Evacuee Property Jammu was pending before the Custodian Department.
However, the accused persons namely Sunil Dutt, son of Sukhchain of Pakhian, Vikaz Ahmed Malik, son of Bashir Ahmad of Bye-Pass Narwal, Mushtaq Hussain Malik, Custodian Jammu and relative of Vikaz Ahmad Malik and Bikram Chargotra, son of Sukhchain of village Pakhian in connivance with each other executed a fake rent deed in favour of accused Vikaz Ahmad Malik, who took the possession of land and established an industrial unit under the name and style M/s Brick Solutions.
It was further alleged that accused Sunil Dutt had no right or authority over the land but by misrepresenting the facts and preparing the fake documents he got the rent deed registered in respect of one kanal of land showing himself as the absolute owner in connivance with the Custodian Evacuee Property, who facilitated the grabbing of the land arbitrarily and illegally.
On the receipt of this complaint, a preliminary verification was initiated in Crime Branch and it was found that the accused persons namely Sunil Dutt, Vikaz Ahmad Malik and Bikram Chargotra had committed the fraud with the active connivance of Mushtaq Hussain Malik, Custodian Evacuee Property, Jammu who being the close relative of Vikaz Malik, in sheer abuse of his official position, facilitated the illegal transfer/ possession of the land through the fake rent deed.
It was also found that accused Bikram Chargotra being a Government servant also committed the criminal misconduct by indulging in the private trade/business in furtherance of a criminal conspiracy hatched with the other accused persons.
“The omissions and commissions, therefore, on the part of Sunil Dutt, Vikaz Ahmad Malik, Mushtaq Hussain Malik, Custodian Jammu and Bikram Chargotra prima facie, constitute offences punishable under Sections 420, 465, 466, 467, 471, 120-B RPC read with Section 5(2) of Prevention of Corruption Act, 2006”, the Crime Branch spokesman said.
