JAMMU, Jan 6: High Court has held that it has limited role in interfering with the transfers of the employees unless the same is vitiated by violation of some statutory provisions or suffers from malafides.
These observations were made by Justice M K Hanjura in a petition filed by Zahoor Ahmed Farooqi challenging the transfer order No.99-JKHC of 2015 dated July 24, 2015 whereby he was posted as Incharge Government Art Emporium Lucknow.
After hearing both the sides, Justice Hanjura observed, “the petitioner cannot challenge the impugned order of transfer on the grounds urged in the petition. The order of transfer is based on administrative exigencies”, adding “the court has no authority or power to sit in appeal against the judgement of the respondents who found the petitioner to be a fit person to man the post against which he has been transferred”.
Accordingly, High Court dismissed the petition.
