JAMMU, July 24: In a petition seeking execution of judgment and decree against judgment debtors including Wild Life Warden Kishtwar, Additional District Judge Doda Amarjeet Singh Langeh has issued directions for filing reply failing which salary head of Department of Forest will be attached.
“The fact that decree passed in year 2017 remains unsatisfied till date only depicts a sad reflection on the part of judgment debtor and Forest Department of Govt of UT of Jammu and Kashmir, more particularly when judgment and decree under execution has remained un-assailed till date”, the court said, adding “the indifference on the part of Commissioner Secretary to Government, Forest Department, UT of Jammu and Kashmir, Chief Wild Life Warden J&K, Regional Wild Life Warden Jammu and Wild Life Warden Kishtwar, all defendants in original suit – is visibly inconsistent with the obligation that is enjoined upon them by virtue of judgment”.
“We don’t care kind of attitude of judgment debtors has only led to exhaustion of decree holders who are toiling to realize the fruit of decree for last nearly seven years. This is unacceptable in a system governed by rule of law”, the court said and issued showcase notices to officials and judgment debtor as to why the details of vehicles sought to be attached by decree-holders be not directed to be attached and appropriate orders for auction thereafter be not issued.
“If the reply of officials is not received by next date of hearing, this court will be left with no option but to attach the salary head of Department of Forest in addition to other coercive measures permissible under law”, Additional District Judge said.
