Court summons ex-MLA in cheque dishonour case

JAMMU, Sept 11: Sub-Judge Jammu Kusum Pandita has summoned Shoib Nabi Lone, former MLA Sangrama and presently District President Pradesh Congress Committee Baramulla in a complaint filed against him under Section 138 of Negotiable Instrument Act regarding dishonour of a cheque amounting to Rs 54.50 lakh.
The summons for personal appearance of Shoib Nabi Lone have been issued in a complaint filed by Harmeet Singh Sasan, son of Gurbakash Singh, resident of Extension Trikuta Nagar, Jammu wherein it is alleged that the complainant had given financial assistance to Shoib Nabi Lone amounting to Rs 54.50 lakh with the condition that he will repay the amount within time as agreed by the complainant and Shoib Nabi Lone but he failed to repay the amount within the stipulated time.
In the complaint, it has further been alleged that after great persuasion Shoib Nabi Lone issued a cheque bearing No.189790 dated July 19, 2018 for an amount of Rs 54.50 lakh in favour of the complainant but the same was dishonoured.
The Sub-Judge (JMIC) Jammu Kusam Pandita in her order has observed, “the complainant has substantiated the allegations against the accused at this stage and prima-facie a case for commission of offence under Section 138 Negotiable Instrument Act has been established and as such the accused is required to be summoned”.
Accordingly, court directed the Registry to issue summons for appearance of accused Shoib Nabi Lone in the court for the next date of hearing— October, 1, 2018.
