Court stays Zeshta Devi Prabhandak Committee elections

SRINAGAR, Mar 22: The First Additional District Judge Srinagar has stayed the holding of elections to Zeshta Devi Prabhandak Committee Srinagar which were slated to be held tomorrow.
The Court has also restrained the Committee from operating the accounts of the Committee at SBI Branch Residency Road Srinagar and Talab Tiloo, Jammu till disposal of the main suit.
The Court issued directives in a petition filed by Satish Totha son of Dinanath Totha of Jawahar Nagar Srinagar, Basant Razdhan son of B N Razdhan of Centaur Quarters Srinagar and Sushil Khushoo son of Jagar Nath Khushoo of Jawahar Nagar, Srinagar against Zeshta Devi Prabandhak Committee Zeathyar Srinagar through its president and general secretary, Bharat Bushan Bhat son of D N Bhat of Hotel Centaur, Srinagar and Rakesh Kaul son of Shambu Nath Kaul also of Hotel Centaur, Srinagar.
The applicants have alleged that the election of the Executive Committee of the “Suit Trust” is being conducted in violation of the Constitution of the Trust and free and fair elections is not expected from the present office bearers of the Managing Committee of the “Suit Trust”.
The Court observed that in view of the matter, there is sufficient material favoring the plaintiffs applicants as to existence of a prima-facie case in their favour. Moreover, inconvenience and irreparable loss would be caused to them at this stage in case interim relief as prayed for is not granted in their favour.
