Court stays DSE order against DAV School

JAMMU, Dec 17: Justice Tashi Rabstan, Judge of State High Court has stayed the July 4, 2015 order of Director School Education, Srinagar invalidating the duly appointed managing committee of DAV School Jawahar Nagar, Srinagar on a  petition filed by the School through its chairman T K Ganjoo against State of J&K through Commissioner/ Secretary to Government School Education and Shah Faizal Director School Education, Srinagar.
The Court has also served the notice to the respondents and desired that they should disclose the powers for revocation of the approval earlier granted and also to show documents to the Court of law whereby petitioner has been afforded an opportunity of being heard before passing the impugned order.
The Court while granting stay over the order passed by Director School Education, Srinagar also observed that order impugned referring SRO 123 of 2010 nowhere envisages powers to the Director School Education, Kashmir for revocation of approval granted to the Management Committee of DAV Public Secondary School passed vide order No 2019-DSEK of 2015 dated 04-07-2015 in absence of affording an opportunity of being heard to the petitioner.
The Court has listed the case for hearing on December 30.
