Court rejects final report in illegal appointments case

JAMMU, May 11: Special Judge Anti-Corruption Doda, Tahir Khurshid Raina has rejected the final report of the Vigilance Organization into illegalities committed in the appointments of Anganwari workers and helpers in Doda district during 2005 and issued directions for filing of fresh final report.
The FIR into the illegalities committed in the appointment of Anganwari workers and helpers in Doda district was lodged on September 23, 2009 and in the year 2013, the final report was prepared.
In the final report, SVO established that accused public servant Babu Ram, the then Child Development Project Officer (CDPO and Member Secretary) by abusing his official position and by acting in league with the other accused namely Suraj Parkash, the then Programme Officer ICDS Doda (Chairman) and Khalid Jahangir, the then District Social Welfare Officer, Doda (Member) made appointment of undeserving candidates as Anganwari workers and helpers.
However, the Vigilance Organization approached the Government for accord of sanction in case of accused Babu Ram only. But the Government declined the same. Thereafter, the final report was placed before the court.
“From the perusal of the final report and the CD file, it comes to the fore that the offence against all the accused officers got established during the investigation. However, the court is astonished to see that why the Vigilance Organization inspite of having all the facts before it had approached the Government for sanction in case of only one accused public servant namely Babu Ram and the other was left out”, Special Judge Anti-Corruption Court Doda, Tahir Khurshid Raina observed, adding “this was done despite the fact that in the final report it has been mentioned that Babu Ram has abused his official position by acting in league with Suraj Parkash and Khalid Jahangir”.
“Though this court cannot direct the Vigilance Organization to seek fresh sanction in case of Babu Ram, but it is well in its powers to make observations”, Special Judge Anti-corruption said, adding “from where Government draw satisfaction of no case against accused Babu Ram speaks volume of the casual approach of competent authority. If such approach remained surviving, the goal of corruption free society will be a mirage”.
With these observations, the court directed SSP Vigilance Organization Jammu to place the material collected during investigation before the appropriate sanctioning authority for considering the grant of sanction for launching prosecution against third in-service accused public servant Khalid Jahangir, the then CEO Kishtwar Development Authority.
The court also rejected the final report and Vigilance Organization was directed to prefer fresh report after doing the needful as per the directions.
