JAMMU, Feb 12: Principal Sessions Judge Kathua, M K Hanjura has rejected the bail application of a narcotics smuggler namely Surinder Singh, son of Kashmir Singh of village Amalla in tehsil Hiranagar, who was arrested along with intoxicant capsules.
After hearing Advocate T N Gupta appearing for the petitioner whereas PP Ravi Gupta for the State, Principal Sessions Judge observed, “looking into the instant petition from perspective of what is stated in the notification, the entire mixture or substance of a particular drug is relevant for determining the quantity of drug and not its pure content”.
“The alleged capsules recovered from the accused falls within the scales of commercial quantity and this attracts the bar created by Section 37 of NDPS Act”, the Court said and rejected the bail application of the accused.
