Srinagar, July 13: A court in north Kashmir’s Bandipora district today rejected the bail plea of the Apni Party DDC member in an assault case.
The DDC member was earlier booked for allegedly assaulting the revenue officials following which the accused was arrested.
The court of Chief Judicial Magistrate (CJM) Bandipora in this regard rejected the bail plea of Ghulam Mohi-ud-Din Rather, the DDC member from the Arin block of the district
The bail application was rejected because the investigation of the case was at the initial stage and that the release of the accused on bail could “derail the investigation of the case.”
“As per report of police the investigation with regard to accused is going on and the investigation has not been completed yet. The investigation of the case is at infancy and admitting accused to bail would derail the investigation,” reads the bail order issued by the CJM Bandipora, Abdul Qayoom Mir.
The order states that the accused has beaten the Government officer, especially Tehsildar Bandipora and has snatched essential revenue documents from them during performing their duty, which, the order stated, is the worst form of conduct which is not expected from any person in a civilized society
“Offence is against society at large as a public servant has been attacked. Keeping in view of the above discussion and in the interest of justice bail application moved by Ld. Counsel for the applicant is rejected. However, this order shall have no effect on the main challan which shall be decided on its own merits.”
Earlier, the DDC member was arrested following a complaint lodged against him. Later a court sent him on 10-day police custody.
