Court rejects bail of lecturer in forged transfer case

Jammu, Dec 12: Second Additional Sessions Judge Jammu, Virender Singh Bhou rejected the bail application of Arafat Ahmed Khan, a lecturer who forged his transfer order.
According to the Crime Branch case was registered by CB against Arfat Ahmed Khan (working as lecturer Computer Science Jakyas, Doda and others for issuing forged and fictitious transfer/ posting orders in the School Education Department under relevant sections of law for in-depth investigation on a complaint of Director School Education Jammu.
Acting on complaint, the Crime Branch Jammu initiated a preliminary enquiry, during which involvement of Arafat Ahmed Khan has prima facie been established, for his role in issuing fake and fictitious orders of transfers/ posting in School Education Department, including his own transfer order from HSS Jakyas Doda to GGHSS Kishtwar.
2nd Additional Sessions Judge Jammu Virender Singh Bhou after hearing APP DP Singh for the Crime Branch observed that In the present case the allegations as emanating from the police report are categorical and pin points the involvement of accused-applicant for the commission of such offences notwithstanding the fact that investigation is in progress and given the conduct of the applicant-accused that he has never appeared before the police, nor cooperated with the police and is absconding and his custody is required by the police and there is every possibility that in case of his admission on bail he would try to pressurize and win over the prosecution witnesses and he may jump over the bail as well cannot be lost sight by this Court.
Court after considering the prayer of the applicant for bail in anticipation of his arrest in the light of the given facts and circumstances of the case and keeping in view the proposition of law laid down by Supreme Court and having regard to enormity of crime committed and the evidence collected in support of the allegations and his conduct in not appearing before the I.O for completion of investigation, the applicant-accused is not entitled to the grant of anticipatory bail. With these observations Court rejected the bail application.
