Court rejects bail of Gujarat Conman

SRINAGAR, May 16: The Chief Judicial Magistrate Srinagar refused bail to Gujarati Conman citing that there is no substantial change of facts and circumstances of the case till date. The Conman had posed as a senior official of the Prime Minister’s Office for four months, and took the administration for a ride, availing for himself Z-Plus security and official protocol in the Valley.
The CJM Srinagar presided by Raja Mohammad Tasleem after considering the arguments of the counsel for accused and Public Prosecutor said the Counsel for the accused- Patel Kiran Jagdish Bhai has not succeeded in establishing a case of any change in circumstances from the filing of first bail application to the instant bail application.
“On the other hand, I respectfully agree with the submission made by PP for the UT of J&K. Accordingly, in my opinion instant successive bail application is devoid of any merit which deserves to be rejected, hence rejected. The application shall go to records after due completion”, he said.
Court said the partly charge-sheet has recently been presented wherein trial has not been started as yet and investigating machinery has prayed that after due completion of investigation a supplementary charge-sheet has to be presented in future, hence the authorities have no application in the case in hand.
Court said that during the course of investigation in the instant case it has been established that accused is also involved in as many as five FIRs wherein investigation has not been concluded and accused seems to be a habitual offender. Besides, nature of the offence is also very serious as the accused has tried his level best to dupe the Government functionaries and seems to be habitual in committing such type of offences. Keeping into account observations the successive bail application is devoid of any merit which deserves to be rejected, hence rejected.
Briefly, police report revealed that Police Station Nishat, Srinagar received a reliable information that a fraudster namely Kiran Bhai Patel of Gujarat has indulged in criminal activities within the jurisdiction of Police Station Nishat, Srinagar and other parts of Kashmir valley and by employing high degree of UT through P/S Nishat Vs. Patel Kiran Jagdish Bhai forged means and with criminal intention has impersonated himself as Additional Director (Strategy and Campaign) PMO, New Delhi.
The said individual, by resorting to cheating, forgery and impersonation has duped gullible people and also intentionally induced people to do and also to omit to do activities, under a well-knit plan for securing monetary as well as material benefits.
