JAMMU, Oct 19: Special Municipal Mobile Magistrate Jammu, V S Bhou has ordered that Ch Nagar Singh should be deported on October 20 and 21, 2012 to CFSL Chandigarh for his voice/image samples. The IGP Jammu was directed to constitute team of adequate number of efficient police officials headed by officer of the rank of DySP, who will escort the complainant to CFSL Chandigarh and back to Sub-Jail Hira Nagar.
Incharge escort team should take the custody of Nagar Singh from Superinten-dent Sub-Jail Hira Nagar early in the morning of October 20, 2010 and lodge complainant back in the jail on October 21, 2012 before sun-set, the Court said and directed the Incharge Sub-Jail Hira Nagar to handover the custody acco-rdingly to incharge escort team constituted by the IGP Jammu.
The voice sample and image sample of the complainant should be recorded/taken by the expert CSFL Chandigrah in the presence of Advocate Manpreet Singh as per the prayer of the counsel complainant. However, he shall be free to take legal assistance from his counsel Advocate RK Kotwal, the court said.
This order has been passed in a complaint filed by Choudhary Nagar Singh against Basant Rath, the then SSP Jammu, Mubassir Latifi, the then SP, Abdul Rouf Lone, Kamaljeet Singh and Hardeep Singh Gill alleging unprecedented torture, both physical and mental while he was in the custody of police for a criminal case under FIR No 247/2009 under Section 302/201/409/120-B RPC at Police Station Gandhi Nagar Jammu.
