Srinagar, Feb 20: A local court granted bail to two women for the offence of attempt to murder with the condition of furnishing personal bail bond and not to leave the jurisdiction of J&K without prior permission from the court.
The court of Additional Sessions Judge Udhampur presided by S R Gandhi granted bail to accused Makhna Devi and Manita Badyal in FIR 94/2020 registered in police station Majalta for commission of offences under Section 302 (murder) and 304 (attempt to murder) of a women.
Court granted the bail to both applicants after their counsel Ayushman Kotwal submitted before the court that there is no legal bar in granting bail for the offence under Section 304 and apart from it he added that the applicants are women and thus, in terms of proviso of Section 437 of CrPC they can be released on bail.
The allegations against the applicants are that they abetted the main accused for demand of dowry from the parents of the deceased as they have been charged for the offence under section 304 IPC. Court after having heard advocate Kotwal and public prosecutor said the offence under which the applicants are arrested and are in jail is punishable with imprisonment as such there is no legal bar for release of them on bail.
Court in view of the facts and arguments advanced by the counsel for applicants said they are entitled to be released on bail subject to furnishing of personal bond to the sum of Rs 50, 000 with on surety of like amount.
Court also directed both the applicants to regularly attend the court on each and every date of hearing and shall not temper with the prosecution evidence in any manner. “They shall not make any inducement, threat or promises to any person acquainted with the facts of the case so as to dissuade him/her from disclosing such facts to the court and in case the applicants misuses the liberty or violates any of the conditions, the prosecution shall be free to move this court for cancellation of the bail”, reads other conditions of the bail order.
