JAMMU, May 14: Principal Sessions Judge Poonch Jaffer Hussain Beigh has granted bail to Mohd Riaz, son of Mohd Shafi, who was accused of committing rape with maid in his house.
After hearing both the sides, the court said, “the trial of the case is at its fag end and only the defence is to lead evidence”.
“The question of accused tampering with the prosecution witnesses does not arise and the offences levelled against the accused are not punishable with death or imprisonment for life”, the court said, adding “it is only in those cases wherein the punishment prescribed is death or imprisonment for life that bail can be withheld”.
Without commenting upon the merits of the case, the court said, “the accused is under detention since July 27, 2013 as such he deserves to be admitted to bail”. Accordingly, the accused was admitted to bail on furnishing of bail bonds to the tune of Rs 50,000.
