Court freezes account of SFC

JAMMU, Mar 16: Taking serious note of non-implementation of court orders, Railway Magistrate Jammu RK Lalhal has ordered freezing of account of State Forest Corporation (SFC).
“Perusal of the file reveals that instant execution petition came to be filed on 07.04.2008 pursuant to passing of the decree dated 15.05.2007. The counsel Anita Tickoo appeared on behalf of judgment debtors on 31.10.2008 and sought time to file objections. On 15.05.2009, again counsel for the judgment debtors sought opportunity to file objections”, court observed.
“Even on 17.01.2018, Shah Faisal, Field Supervisor appeared on behalf of judgment debtors. Despite of ample opportunities, judgment debtors did not bother to file the objections. Perusal of the file reveals that this execution petition is pending for the last more than 15 years for a meager decretal amount of Rs 18,600 along with Interest @ 10% per annum from the date of filing of suit till it is liquidated as ordered by the court”, Railway Magistrate observed.
“It is surprising and unfortunate that decree holder is appearing for the execution of the same for the last more than 15 years and judgment debtor did not bother for same. Now the court is left with no option other than taking the coercive measures to recover the decretal amount and to get the fruits of the decree in favour of decree holder”, the court said.
Accordingly, court ordered freezing of bank account of the judgment debtors (State Forest Corporation) till the realization of the decretal amount or further order.
