Court frames murder charge against 2 brothers among 3 accused

JAMMU, Mar 5: Court of 2nd Additional Session Judge Jammu has framed murder charge against two brothers among three accused, who had alleged killed 19-year old Sunil Kumar alias Tinu, son of Kala Ram of Rakh Kharuni, under the jurisdiction of Police Station Gharota on April 17, 2017.
Charges under Section 302/392/201/34 RPC have been framed against Liakat Ali, son of Ali Mohd of Seri Bhalwal Jammu/Qazigund Kashmir, Reyaz Ahmed, son of Abdul Gafoor and his brother Mushtaq Ahmed, both resident of Khabad Treyath Rajouri/Newa Pulwama, Kashmir in case FIR number 51/2017 at Police Station Gharota, Jammu.
After hearing SPP Deepak Mahajan and the counsel appearing for the accused persons, 2nd Additional Session Judge, Virinder Singh Bhou ordered framing the charges and put the accused to trial. He also directed the prosecution to produce witnesses for evidence on March 23 and 24, 2021.
“On the basis of evidence on record, I am of the prima facie view and satisfied that there are strong grounds for presuming that the accused persons have committed offences punishable under section 302/392/201/34 RPC,” observed the Judge while rejecting plea of the defence counsel that disclosure statement made by accused persons cannot be given weight-age and is devoid of merit.
As per the case FIR, deceased Sunil Kumar, who was dealing in the trade of buying and selling goats and sheep and had some transaction dispute regarding the same with the accused persons, had gone missing after he left his home on April 17, 2017. On complaint of father of Sunil Kumar, FIR was registered at PS Gharota and during the course of investigation, the accused had confessed the crime. On their disclosure, skeleton bones of dead body of the deceased, his blood stained clothes and other articles were recovered from Seri forest.
