JAMMU, Mar 19: Chief Judicial Magistrate (CJM) Reasi Amarjit Singh Langeh today dismissed the plea of alleged criminal seeking registration of FIR against cops.
“A growing trend in recent times to invoke provisions of Code of Criminal Procedure regarding investigation and inquiry as a handy tool against public officials performing public duty is not only unenviable but also un-acceptable”, the court said, adding “the present application seems to be based on set of wholly concocted allegations and thus does not disclose commission of any cognizable offence albeit prima facie and thus is dismissed/ rejected”, the court.
During the course of jail visit at Sub Jail Reasi, applicant who is detained there for his alleged involvement in FIR No. 81/2020 for offence under Section 376 of IPC presented an application to Chairman DLSA (Principal District and Sessions Judge), Reasi seeking action against police officers/ police officials of Police Station Mahore for allegedly implicating him in a false case.
This application in turn was forwarded to the court of Chief Judicial Magistrate for disposal under law.
After going through the status report filed by SSP Reasi, the CJM observed, “the applicant is trying his level best to mislead the administration and has left no stone unturned to implicate those who have taken action against him”, adding “it is also asserted that applicant can go to any extent to malign images of officials with an objective to get benefit in the case sub judice against him for offence under Section 376 of IPC”.
“Whole trajectory of allegations in the application at hand seems to have been cleverly couched to invoke Section 156 of CrPC (registration of FIR against non-applicants) not only to embarrass and falsely rope in the non-applicants who happen to be Sub-Divisional Police Officer, Station House Officer and other police officials of Mahore sub-division but also in the fond hope that this course may offer some assistance to him in a sub judice case under Section 376 of IPC “, the CJM said while dismissing the application.
