Srinagar, Oct 4: A local court has directed both factions of Jammu and Kashmir Cricket Association to maintain status quo with regard to operation of bank accounts in the name of Jammu and Kashmir Cricket Association.
The direction for maintaining status quo has been passed by 2nd Additional District and Sessions Judge Srinagar Sham Lal in a suit filed by Dr. Farooq Abdullah faction association. There are two factions of the JKCA, one headed by former Union Minister Dr. Farooq Adbullah and another Minister for Youth Services and Sports, Imran Raza Ansari
Counsel representing Ansari faction resisted passing of order of status quo in the case, however, the counsel representing Dr Abdullah faction argued the matter at length and submitted before the court that both parties be restrained with regard to operation of accounts of association till other side (Ansari faction) including bank authorities file their objection in the case.
Court accepted the submissions of the counsel representing Abdullah faction and observed since other side has not filed objection to the case till date therefore, “In view of the above and in the interest of justice, it is directed to all the parties to file the suit to maintain status quo till objections are filed and considered”, court directed.
The case has been filed against Chairman JK Bank, Youth Services and Sports and Minister Imran Raza Ansari, Mehboob Iqbal, Iqbal Shah and Abdul Rouf and court earlier had issued notice to all of them for filing their reply against the please made in the case by Abdullah. However, no response came from the Ansari faction till date which prompted the court passing order in favour of Abdullah faction.
Dr Abdullah along with general secretary M L Nehru seeks relief from the court that the account opened in J&K Bank in the name of Plaintiff Association at the instance and connivance with Sports Minister and his associates be declared as null and void.
They are further seeking direction from the court that Ansari and his Associates have no authority to maintain, run and operate any Bank Account of Association including numbers at Branch office Air Cargo Srinagar and BC Road Jammu.
“Defendants Ansari and his Associates be directed to restrain themselves from dealing with any way or operating the Bank Accounts of the Plaintiff-Association except the Plaintiff-Association and its duly authorized nominees”, says the case of Abdullah.
Dr Abdullah and his associates allege that the Bank authorities have allowed the operation of these accounts by some unauthorized persons illegally and unauthorizedly pursuant to the so-called meeting and so-called election of the JKCA held on July 20 by the Ansari Group despite the fact that the said meeting and elections were put on hold by a local court at Jammu.
It is further contended by Dr Abdullah that they lodged a strong protest against the inaction of the Bank authorities and they (Bank) assured them that the matter will be looked into and appropriate measures will be taken in this regard but they did not respond resulting into filing of instant case against the Bank authorities and Ansari Association.
