Court directs SSP to execute arrest warrants of cops

Srinagar, Apr 16: A local court today exempted Inspector General of Police from personal appearance in the court in connection with the killing of a minor in police firing in 2010 protests and directed the SSP Srinagar to execute the arrest warrants.
Chief Judicial Magistrate, Srinagar, V S Bhou, observed that it appears that IGP has been commanded to get the warrants executed so it is not mandatory for him to execute warrants personally rather has to ensure execution of warrants so as to procure attendance of the accused before the court.
The court directed the SSP Srinagar to ensure execution of arrest warrants of the accused cops. The directions came after SSP Srinagar stated that neither the SHO Nowgam nor the Principal STC Talwar Jammu executed the warrants.
Earlier court had summoned IGP police in court with direction to produce two accused cops before the court. However, today IGP Kashmir moved an application for exemption of personal appearance.
The counsel for the complainant while objecting IGP’s application argued that he has not complied with the directions issued from time to time. The counsel pleaded that contempt notice be issued to IGP Kashmir and proceeding be started against him under law.
The CJM directed SSP Srinagar to conduct an inquiry against SHO Nowgam as to why he failed to arrest the accused Assistant Sub-Inspector Abdul Khaliq Sofi and report be communicated to the court.
The court also directed Principal STC Talwara to tender explanation for his lapse to execute warrants against Constable Mohammad Akram
Wamiq Farooq, a 7th standard student, was killed on January 31, 2010 when a teargas shell allegedly fired by the police hit him.
Soon after Wamiq’s killing, his father, Farooq Ahmad Wani had filed a complaint before the CJM seeking registration of an FIR under Section 302 RPC against the accused Sub-Inspector Abdul Khaliq and SPO Mohammad Akram.
Citing that “sufficient material of commission of offences” about the accused cops was available, the Additional District Sessions Judge, Srinaagr, Parvaiz Ahmad Kachroo, had dismissed the revision petition filed by police and directed it to produce cops before the trial court.
The court has repeatedly expressed displeasure against police for disobeying the orders.
