JAMMU, Oct 4: Railway Magistrate Jammu Yahaya Firdous Ahangar today issued directions for registration of FIR against Balkar Singh alias Balkeet Singh, Secretary J&K Rural Cooperative Housing in a rape case.
After hearing Senior Advocate B S Salathia with Advocate Ravinder Sharma for the applicant, the court observed, “the complainant is aggrieved of the act of the accused who allegedly induced her for sex under the pretext of providing a plot at a meager cost of Rs 40,000”.
“It is alleged that she approached Police Station Channi Himmat for lodging the FIR and the police recorded her statement. Thereafter, SHO refused to register the case as such she was constrained to approach the court”.
Accordingly, the court directed SHO Police Station Channi Himmat to proceed with the complaint of the complainant, investigate the matter in terms of Section 156 (3) CrPC and register the case.
“SHO after registration of FIR shall produce complainant before Judicial Magistrate for recording her statement under Section 164-A CrPC so that the investigation can be directed”, the court said.
