JAMMU, Nov 20: In a complaint filed by Bharatiya Janata Yuva Morcha against separatist leader Syed Ali Shah Geelani for his alleged statement that guns can be permanent solution for the State, Chief Judicial Magistrate Jammu, S R Gandhi today directed SSP Crime Branch to conduct preliminary enquiry to ascertain whether cognizable offence is made or not and if cognizable offence is established then SSP Crime Branch Jammu shall register FIR and investigate the matter.
According to the complaint, Syed Ali Shah Geelani has been spitting venom on the so called Kashmir issue for the last couple of decades and is a major contributor to the instigation of local Kashmiri youths to take up guns against the security forces and innocent people which has led to massacre of thousands of people including security force personnel.
It has also been submitted that Geelani is responsible for creating a situation of terror because of his extreme views and hatred which created the circumstances of mass migration of members of one community from Kashmir valley.
“A look at the statement of Syed Ali Shah Geelani clearly reveals that he has attempted to bring hatred and excite dis-satisfaction towards the Government established by law. The statement is also an offence as defined by Section 153-A RPC”, the complainant said, adding “the utterance of Geelani is also an offence punishable under Section 153 as it is made with an intent to given provocation to cause riots. Moreover, the statement is also punishable under Section 153-B RPC as the statement is prejudicial to the maintenance of the harmony”.
