JAMMU, June 26: In a case pending for prosecution evidence involving offences under Sections 376/363 of RPC, Fast Track Court Jammu today directed Inspector General of Police (IGP) Jammu to seek explanations from the then SDPO and the then SHO R S Pura regarding.
The direction was passed when court noticed that despite being alleged victim in the case, prosecutrix has not been cited as witness by investigating agency in the challan.
Expressing surprise over omission by investigating agency, Presiding Officer (Sessions Judge) Amarjeet Singh Langeh observed, “three officers investigated the case and the then SHO recorded satisfaction with investigation and presented the challan but ironically alleged victim has not been cited as witness in the case”.
“This prima facie speaks volumes about casual and reckless manner adopted by investigating agency in putting up instant case for trial”, the court said, adding “not only this, the then SDPO R S Pura also accorded approval for presentation of challan before competent court of law without noticing the defect”.
With these observations, court directed that copy of order be sent to Inspector General of Police, Jammu for his indulgence so that appropriate explanations can be sought from two officers.
