Court denies pre-arrest bail in attempt to murder case

JAMMU, July 17: Principal Sessions Judge Jammu, Jang Bhadur Singh Jamwal today rejected pre-arrest bail application of Vipan Massi and Haldy Nar allegedly involved in attempt to murder case and withdrew the interim order dated July 10, 2012.
The accused persons had made murderous attack on Satnam Singh on June 29, 2012 and since then they have been absconding.
After hearing Advocate Pankaj Badyal appearing for the petitioners whereas Public Prosecutor Shabir Choudhary for the State, Principal Sessions Judge, Jang Bahadur Singh Jamwal observed, “the crime rate is considerably increasing day by day and the accused in the present case are seeking protection of the Courts after committing the heinous offences. In case such kind of practice by the petitioners/accused is not prevented there is likelihood of creating chaos in the society”.
“The scanning of the case diary as well as the police report has emanated that the petitioners after the commission of such a heinous offence are at large and are seeking protection of pre-arrest bail. The weapons of offences are yet to be recovered from the petitioners and in case, the pre-arrest bail is granted to them, there is likelihood that the weapons of offences may not be recovered”, the Court further observed.
“In such circumstances, the custodial interrogation of the petitioners is required to be conducted for the purpose of investigation and for recovery of weapons of offences”, the Court said and dismissed the pre-arrest bail application of accused.
