Court denies bail to Dy Secy JKAACL in appointment case

JAMMU, Feb 27: Special Judge Anticorruption Jammu YP Bourney today rejected the bail application of Syed Shakeel-ul-Rehman, Deputy Secretary J&K Academy of Art, culture and Languages in an appointment case.
The accusations against the Deputy Secretary were that he had conspired with other accused and in furtherance of the conspiracy subverted/faked the entire selection process to manage appointment in the Academy of Art, Culture and Languages.
A written complaint in this regard was filed by Dr Javed Rahi and others with the Crime Branch Jammu and after preliminary verification FIR for offences under Section 420, 467, 468, 471 and 120-B RPC read with Section 5(2) of Prevention of Corruption Act was registered and accordingly he was arrested on February 19, 2020.
The Deputy Secretary filed application seeking his release on bail on various grounds.
After going through the bail application and perusal of the CD file, the Special Judge Anti-Corruption observed, “the allegations against the accused/applicant and others are well  founded and series of offences alleged to be committed by him and others in the process are henious in nature, which carry imprisonment for life or imprisonment of either description for ten years besides fine”.
“As regards, the possibility of accused applicant to subvert the legal process and influence the witnesses or tamper with the evidence this court has no hesitation in recording the observations that a person like applicant, who managed and high jacked the entire selection process single handily for securing his appointment to the post for which he was not even eligible to apply by dodging and surpassing the candidates having for superior merit and experience in the field  doesn’t deserve bail”, the Special Judge Anti-Corruption said, adding “it is disturbing that he has been allowed to roam freely for too long time even after the indictment and came to be arrested when investigation was nearing completion”.
The court also directed SSP Crime Branch Jammu to expedite the completion of investigation as lot of time has already been lost in the process of preliminary verification and investigation.
