Court denies bail to ASI in trap case

JAMMU, Dec 7: Special Judge CBI cases Jammu Sanjeev Gupta today rejected the bail application of Assistant Sub-Inspector Sham Lal, who was caught red-handed by the CBI while accepting bribe.
“The petitioner, an officer of significant importance in the police hierarchy, in the discharge of his official duty, fell for greed and exhorted graft money from the complainant inside the Police Station Bishnah by abuse of his official position in a brazen manner under the colour of his uniform, instead of addressing the grievance of complainant”, the court observed.
“The police perform the duties which the law has assigned to them. They are entrusted to protect the public against violence, crime and other harmful acts. The police must act by following the law to ensure that they respect it and apply it in a manner which matched their level of responsibility. Office of public power cannot be the workshop of personal game”, the court further said, adding “supposed to be a law enforcer, the petitioner in the case in hand has behaved like law in himself and owing to menace of corruption perpetrated by such type of delinquents in the Police Department the society is losing faith in the system”.
“Sooner the corrective measures are taken better it is for public good. In the facts and circumstances of the case, considering the gravity of the offence and materials in the case diary, which prima facie shows involvement of the petitioner in the offence, I think the social concern in the case at hand to be given priority over lifting the restriction of liberty of the petitioner”, the Special Judge said.
