JAMMU, Dec 30: 1st Additional Sessions Judge Jammu, M A Choudhary has awarded seven years rigorous imprisonment and fine of Rs 50,000 to five persons under Section 304-II (culpable homicide not amounting to murder).
The convicts are Sanjay Kumar, son of Balwant Raj, Balwant Raj, son of Mohan Lal, Birbal, son of Bhagat Ram, Anil Kumar, son of Birbal and Vikram Kumar, son of Balwant Raj, all the residents of New Plots.
According to police case, one Suresh Kumar, son of Suraj Parkash of New Plots had engaged Ashwani Kumar for preparing video cassette of the Mundan ceremony of his son. Though Suraj Parkash made full payment to Ashwani Kumar, the latter refused to hand over the video cassette.
On July 3, 2008 when Suresh Kumar had gone to market for bringing some vegetables, Ashwani Kumar met him and both entered into altercation over the video cassette issue. On July 5, Suresh Kumar was intercepted in Street No.6 in New Plots area by accused persons, who were carrying swords, sticks and bricks. In order to save his life, Suresh Kumar entered the house of Naresh Kumar, son of Thakur Dass.
The accused chased him and trespassed into his house and the accused asked Naresh Kumar to handover Suresh Kumar to them. Further they also threatened to eliminate Naresh Kumar in case Suresh Kumar was not handed over to them. Naresh Kumar and his father Thakur Dass requested the accused not to indulge in fighting. However, the accused dragged out Thakur Dass from his residential house and beat him severely. The injured Thakur Dass was taken to GMC hospital but he succumbed to the injury while being shifted to hospital.
After hearing both the sides, Ist Additional Sessions Judge observed, “prosecution has succeeded to prove its case to bring home the charge for the commission of offences punishable under Sections 304-II, 149,147,336,337 RPC”.
“All the accused are thus convicted for the commission of offences punishable under Sections 304-II/149/147/336/ 337 RPC”, the court said. With these observations, court awarded rigorous imprisonment for 7 years and fine of Rs 50,000 each to the accused persons.
