JAMMU, Mar 25: Principal Sessions Judge Kathua, A K Koul today awarded two years imprisonment and fine of Rs 5000 each to Parshotam Lal, son of Dharam Chand, Damnesh Kumar, son of Ram Chand and Rakesh Kumar, son of Parshotam Lal, all residents of Pathwal, Kathua, who were facing trial in murderous attack on one Prakash Chand.
After hearing PP Ravi Gupta for the State whereas Advocate T N Gupta for the accused persons, Principal Sessions Judge Kathua AK Koul observed, “the accused have been convincingly proved to have assaulted the injured thereby inflicting grievous injures to him. They have done so in furtherance of common intention”.
“They are, accordingly, convicted under Section 325 read with Section 34 RPC. The accused are facing trial since last six years and need to imagine the trauma, pain, inconvenience and loss of financial resources, they must have suffered”, the court said, adding “all the three accused appear to be young and so keeping in view all the facts and circumstances, a harsher punishment would not only put them to peril but also affect their families adversely and that too for no fault on their part”.
Accordingly, the Court awarded imprisonment for two years and imposed fine of Rs 5000 under Section 325 RPC.
