JAMMU, Aug 30: Principal Sessions Judge Jammu, Kartar Singh today awarded 10 years rigorous imprisonment and fine of Rs 1 lakh to a trans-border smuggler Gurdev Singh, son of Karnail Singh of Amritsar, who was facing trial in smuggling of five kilograms of heroin.
According to the case, on the intervening night of April 6-7, 1997, an information was received that some persons were coming from Pakistan side and about to cross the border. At about 4 am, movement was noticed on the border with night vigil device but Pakistan resorted to firing to give cover to those attempting to cross the border. During the search operation in the area, Gurdev Singh, who was hiding himself near the bushes, was apprehended and from his possession 5 kilograms of heroin was recovered. After completion of investigation, challan was presented in the court of law.
After hearing Special PP for Customs Department, D N Pangotra whereas Advocate S D S.Saini for the accused person, Principal Sessions Judge observed, “offence under Section 21/23/ NDPS Act stands proved against the accused Gurdev Singh, who smuggled five kilogram of heroin from Pakistan to India and was caught red handed at BOP Alpha Machaal by the Naka party of BSF and custom officers”.
Accordingly, the court awarded rigorous imprisonment for a period of 10 years and fine of Rs one lakh to the trans-border smuggler.
