Court acquits Malik, Geelani in 22-yr old cases

Srinagar Dec 31: A local court today acquitted Chairmen of Jammu and Kashmir Liberation Front (JKLF) and Hurriyat Conference (G) and several other separatist leaders in over a two decade old cases.
The Court of 3rd Additional Munsif Srinagar, Fouzia Pal, acquitted these leaders after prosecution failed to provide any evidence against them in cases registered in 1998 by the Police in Police Station Ram Munshi Bagh.
Last month Court issued summons to several separatist leaders in two cases – State versus Syed Ali Shah Geelani and State versus Mohammad Yaseen Malik. Those who were summoned include Syed Ali Shah Geelani, Professor Abdul Gani Bhat, Yasin Malik, Javed Mir, Dr Ghulam Mohammad Hubbi, G N Zaki in one case and to Yasin Malik, Javed Mir and Shakeel Bakhshi in another case.
The proceedings were held on fast track basis during last over a month after High Court directions on speedy trail of decade year old cases. These cases were registered under section 353 of CrPC which is assault on public servant in execution of his duty and Section 332 of CrPC which is hurting a public servant in discharging his duty.
These cases were registered against holding a a protest march by separatists in 1998 in Srinagar. The case was registered in Police Station Ram Munshi Bagh, Srinagar.
The prosecution failed to provide evidence against the accused and judge acquitted them in these leaders in these two cases and dismissed the case.
The judge sought personal appearance of Yasin Malik and Syed Ali Shah Geelani and Counsel for these two separatist leaders Advocate Aijaz Ahmad Dar and Advocate Bilal Ahmad Wani informed the Court that Malik is Jailed in Tihar and Geelani is under house arrest and is ailing so can’t be produced. Later after affedevits were filed by the families of these leaders and they were acquitted in these two cases.
