Court acquits accused in narcotic case

JAMMU, Aug 20: Principal Sessions Judge Jammu, Jang Bhadur Singh Jamwal has acquitted Dilawar Kumar, son of Mela Ram of Kashmiri Mohalla, Akhnoor, who was facing trial since April 17, 1999 in narcotics case.
According to prosecution case, on February 20, 1999 Dilawar Kumar was arrested and on his disclosure 70 liters acetic anhydride was recovered. Accordingly, a case under Section 9-A,25/A NDPS Act was registered against him and after completion of investigation challan was presented in the court of law.
After hearing Public Prosecutor Shabir Choudhary appearing for the State whereas Advocate Anil Bargotra for the accused person, Principal Sessions Judge observed, “prosecution has violated the mandatory provisions which are required to be complied with and there are lot of contradictions in the statements of various prosecution witnesses and lot of discrepancies also”.
“Prosecution witnesses have contradicted with each other and have not tendered any evidence supporting the version of prosecution and do not inspire confidence. The discrepancies and contradictions referred thereto pertain to the core of the case and material cannot be ignored”, the Court further observed, adding “prosecution has utterly failed to bring the guilt of the accused to home”.
With these observations, Court acquitted the accused of the charges.
